Cooling-off period 14 calendar days from enrolment

1

Introduction

This Refund Policy has been developed to provide clarity on Open Academy London's position on the limited circumstances in which a refund of fees will be considered. It should be read alongside our Terms & Conditions.

2

Scope

This policy applies to all fees paid to Open Academy London, including course fees, deposits and any related charges, unless otherwise stated in your enrolment agreement.

3

Aims of this policy

  • To help learners understand the limited circumstances where a refund of fees paid, or cancellation of fees due, will be considered.
  • To ensure refunds are applied consistently across the Academy.
  • To provide clarity on how any refund due is calculated.
4

Your right to cancel

Where enrolment is completed and you have signed all related paperwork, we comply in full with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and will provide a full refund of any fees paid, except where indicated otherwise, if cancellation is received within 14 calendar days of your initial enrolment and before the course has started.

If your course starts within that 14-day period, any refund will be adjusted to reflect the proportion of the course already delivered at the point of cancellation. Once the 14-day period has elapsed, our standard refund and fee recovery terms in sections 5–15 below apply.

5

Refunds on withdrawal

  • Before your course starts: a full refund, less your initial deposit.
  • Within the first two teaching weeks: a refund of 50% of the course fees. Where fees paid in advance are less than 50% of the course fee, the balance remains payable.
  • After two teaching weeks: no refund is given, and any outstanding fees remain payable.
  • Short courses (one term or less): no refund is given on withdrawal.

All withdrawals must be notified to us in writing. The effective date for calculating any refund is the date we receive your notice.

6

Materials and kits

Refunds are not given for materials or kits (for example books or equipment) purchased as a requirement for your course. If you withdraw, any outstanding kit fees remain due.

7

If we cancel or reschedule a course

Cancellation by us: if we cancel a course, or it does not start due to insufficient enrolments, we will make every effort to offer a suitable alternative. If no suitable alternative is available, you will receive a full refund.

Rescheduling: if we reschedule a course to a different time or day and this is not convenient for you, you will receive a 10% refund of the full course fee. No refund is given for a change of campus.

8

Illness or long-term circumstances

If you become ill during your course, you may apply for a refund if your condition is permanent and prevents you from continuing. If the condition is temporary, you may instead apply for a credit that lets you re-enrol at a later date (credits are valid for 2 years). Any refund or credit is calculated pro-rata from the date of your last attended class. Your deposit and any exam fees are not refundable, and a credit cannot later be converted into a refund.

Medical evidence, such as a doctor's note or equivalent, will be required to support a request under this section.

9

General absence

We are unable to give refunds for absence caused by changes in work commitments, personal or financial circumstances, or any other reason preventing attendance. Any outstanding fees in these circumstances remain payable.

10

Withdrawal at our discretion

Where a learner's withdrawal results from a failure to adhere to our policies (for example attendance, behaviour, health and safety, or discipline), no refund is given and any outstanding fees remain payable.

11

Sponsored learners

A sponsor (for example, an employer paying for an employee) may apply for a refund where the criteria in this policy are met. If a sponsorship arrangement ends, or the learner withdraws, fees remain due and no refund is given. Where a learner is sponsored, any applicable refund is made only to the sponsor.

12

Quality concerns

If you are dissatisfied with your course and this cannot be resolved with your tutor or Centre Manager, please raise it through our Complaints Procedure. We will always look to address any issues raised; a refund will be issued where considered appropriate, at our sole discretion.

13

How to request a refund

If the criteria above are met, please request a refund by contacting us at info@openacademylondon.co.uk or +44 7579 779644, and provide any relevant supporting paperwork. Refunds may take up to 4 weeks to process.

14

Fees and loan funding

Where you have applied for loan funding to cover course fees (for example a 24+ Advanced Learning Loan payable by Student Finance England), payment of your fees may be deferred while the loan is processed. If your loan application is unsuccessful, the full outstanding fee becomes due and our standard payment options apply. If loan funding received is insufficient to cover the balance of your fees – for example if payments stop following withdrawal – the remaining fees become due.

15

Recovery of outstanding fees

Recovering outstanding fees is fundamental to the ongoing viability of the Academy, and we will take all reasonable measures to do so. If fees are not paid within agreed timescales, we will first send a written reminder – if you are experiencing financial difficulty, please contact us as early as possible to discuss arrangements. We reserve the right to use debt recovery specialists, including the reasonable costs of recovery as part of the overall debt, and to pursue recovery through the civil courts where necessary.
