About us

Courses are provided by Open Academy London Limited ("Open Academy London", "we" or "us"), a company incorporated in England and Wales with company number 12049808, registered office at 111, Cumberland House, 80 Scrubs Lane, London NW10 6RF.

We will use reasonable endeavours to provide the Courses we advertise, using reasonable care and skill. We may appoint independent sub-contractors or third parties to assist in delivering a Course; our obligation is to use reasonable care in selecting competent providers, and we are not responsible for their acts or omissions.

4

Enrolment and the contract

To enrol on a Course you must provide accurate, complete information and pay the amount specified. Submitting an enrolment is an offer to purchase a Course on these Terms; a binding contract only comes into existence once we send you an order confirmation email (with access/log-on details, where applicable) and we have received the required payment.

Where your order includes multiple Courses, each is treated as a separate offer; acceptance of one does not imply acceptance of another. We reserve the right, without needing to give a reason, to decline to accept an enrolment, in which case no contract arises and any payment made will be returned. We also reserve the right to amend an advertised Course Fee or Course description before a contract comes into existence.

Please check your order confirmation email carefully and contact us immediately at info@openacademylondon.co.uk if anything is incorrect.

5

Fees and payment

Course Fees are shown on our Website and/or in a Brochure, or notified to you directly, and are inclusive of VAT where applicable. All amounts are payable in Pounds Sterling; any currency conversion costs are borne by you.

Unless stated otherwise, the Course Fee is payable either as a one-off lump sum, or in instalments (subject to availability and our discretion), with the first instalment due with your enrolment and subsequent instalments collected automatically. You must tell us promptly if your payment card changes or expires. Failure to pay an instalment when due is a breach of contract and may result in loss of the instalment option, suspension of access to the Course, and/or the balance becoming immediately payable.

Payment is accepted by the methods shown at enrolment, which may include card payment, PayPal, or bank transfer arranged directly with us.

6

Cancellation, deferral and refunds

You have a statutory right to cancel within 14 calendar days of enrolment under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Beyond that period, refunds, deferrals and cancellations by us are governed by our Refund Policy, which forms part of these Terms. Your Course Deposit is non-refundable except where our Refund Policy or applicable law says otherwise.

7

Course access and materials

Your order confirmation will tell you when and for how long you will have access to your Course. Access to a Course and its Materials is personal to you; unless we agree otherwise in writing, you may not share, transfer or resell your access to any other person.

You may incur your own internet service or device charges while accessing Course Materials; these are your responsibility. We reserve the right to monitor access to Course Materials and to suspend or terminate access, without refund, where access rules are breached.

8

Conduct

We operate a zero-tolerance policy towards inappropriate behaviour. Abusive or violent behaviour directed at our staff or other learners, and unfair or dishonest practices (including in assessments), will not be tolerated under any circumstances. We may, at our reasonable discretion and without liability or an obligation to refund fees, refuse to continue providing a Course to a learner who engages in such behaviour, subject to our disciplinary procedures.

9

Changes and technical availability

We may make reasonable modifications or enhancements to a Course from time to time; these will not entitle you to a refund provided the Course still meets its advertised description. We will use reasonable endeavours to keep our Website and online Course systems available, but cannot guarantee uninterrupted or error-free access, and we may suspend access for scheduled or emergency maintenance. We are not responsible for disruption caused by matters outside our reasonable control, including internet or telecommunications failures, or issues with your own hardware, software or network.

10

Warranties and disclaimer

We will provide Course Materials in accordance with the Course description on our Website or in a Brochure. We do not guarantee that you will achieve a particular result, grade or qualification, or that Course Materials will be error-free or compatible with your own hardware or software, unless expressly stated otherwise. Courses are provided for training and educational purposes only.

11

Limitation of liability

Nothing in these Terms limits or excludes our liability for fraud or wilful default, for death or personal injury caused by our negligence, or for anything else which cannot lawfully be limited or excluded. Subject to that, we are not liable for indirect or consequential losses, loss of income, loss of business, loss of anticipated savings, or loss or corruption of data, and our maximum aggregate liability to you in connection with a Course is limited to the Course Fee paid or payable by you for that Course. It is your responsibility to back up your own data and coursework. This section does not affect your statutory rights.

12

Intellectual property

Open Academy London and/or its licensors own all intellectual property rights in our Courses and Course Materials. On payment of the applicable fee, we grant you a personal, non-exclusive, non-transferable licence to access the Course and use its Materials solely for your own study. You may not copy, reproduce, re-publish, sell, broadcast, distribute, adapt, reverse engineer or create derivative works from any Course Material without our prior written permission.

13

We may update these Terms from time to time to reflect legal or business requirements; updates will be posted on our Website. You may not assign or sub-contract your rights or obligations under these Terms without our written agreement; we may assign, transfer or sub-contract ours at our discretion. If any part of these Terms is found unenforceable, the remainder continues in full force and effect. No failure or delay by us in enforcing a right under these Terms operates as a waiver of it.
